The petitioner seeks bail in connection with Ghorasahan P.S. Case No. 53 of 2015 registered for the offence punishable under Sections 366(A)/34 of the Indian Penal Code. Allegedly, Indu Kumari, the daughter of the informant, and Khushbu Kumari, the daughter of Birbahadur Sah, both aged about 14 years were kidnapped by the petitioner and other co-accused. During investigation the statements of both victims were recorded under section 164 Cr.P.C. wherein both have supported the allegation of kidnapping but have not stated regarding any sexual harassment.
Submission is of false implication and that it is a case
Patna High Court Cr.Misc. No.639 of 2016 (3) dt.09-03-2016 2/2 of love affair, both victim went out of their own sweet will and returned back, nothing illegal act was done against her and petitioner is suffering in custody since 16.02.2015 having no criminal antecedent.
Learned A.P.P. fairly submits that both victims have not stated regarding any sexual harassment.
In view of the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Sikrahana, at Dhaka, East Champaran in connection with Ghorasahan P.S. Case 53 of 2015, subject to conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
