JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2019 This application has been filed on behalf of the petitioners praying for modification of the order dated 29.01.2019 passed in Cr. Misc. No. 4770 of 2019, whereby they were granted bail.
Learned counsel representing the petitioners admits that in fact the errors in the order were crept in due to error in the pleading itself. In the prayer portion of the application, in place of learned Additional Sessions Judge-II cum Spl. Judge, Araria it was wrongly typed as learned Additional Sessions Judge-II cum Special Judge, Purnea, and due to the aforesaid error in the petition, error was crept in the order dated 29.01.2019.
Considering the prayer made in the present
Patna High Court Cr.Misc. No.6942 of 2019(2) dt.06-02-2019 2/2 application, correction in the petition is allowed. Consequently, in the order dated 29.01.2019 in Cr. Misc. No. 4770 of 2019 instead of Additional Sessions Judge-II cum-Special Judge, Purnea it should be read as Additional Sessions Judge-II cum Special Judge, Araria.
Similarly, the office has to rectify the mistake occurred in the top of the cause title of the order dated 29.01.2019 in Cr.Misc. No. 4770 of 2019 and instead of Purnea it should be read as Araria.
Accordingly, office is directed to transmit the order dated 29.01.2019 to the court concerned at Araria. With the aforesaid, this application stands disposed of. (Anil Kumar Upadhyay, J) mrl./- U T
