The petitioner seeks bail in Mahua P.S. case No. 615/2019 registered under Section 379/411 of the Indian Penal Code.

The informant alleged that his driver loaded 80 bags, each containing 25 kg beaten rice, on his Tata DC vehicle and parked the vehicle on his own Darwaja. In the next morning the vehicle was found missing.

The learned counsel for the petitioner submits that petitioner is not named in the FIR. 15 kg of beaten rice is said to have been recovered from the house of the petitioner and on the basis of such recovery, that too without any identification, the petitioner has been made accused. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. case No. 615/2019.
