JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18-10-2019 It appears that earlier when the electricity connection of the petitioner was disconnected after a raid was conducted in the premises of the petitioner in which he was found consuming connected load of 19HP as against the sanctioned load 6HP, the petitioner moved before the learned District Consumer Forum and the learned District Consumer Forum passed an interim order on 25.08.2011
Patna High Court CWJC No.17201 of 2018(2) dt.18-10-2019 2/3 whereunder the petitioner was directed to deposit 1⁄4 amount of the bill in question and thereupon the respondents were directed to restore the electricity line of the petitioner. It further appears from the counter affidavit that after the petitioner deposited a sum of Rs. 37350/- along with R.C.+ D.C. charge of Rs. 600/- which was 1⁄4 of the bill amount of Rs. 1,49,398/-, the electricity line of the petitioner was restored. Thereafter, once again the petitioner failed to pay the arrears of electricity dues of Rs. 3,80,741/- as on 22.10.2013 and thereupon the electricity line of the petitioner has again been disconnected.
In the writ application there is no statement that the petitioner has deposited the arrears of bills. The only prayer which has been made is to direct the learned District Consumer Forum to dispose off the pending complaint case No. 59/2010.
In the given facts and circumstances of the case, since, at this stage, the petitioner is only praying for a direction to the District Consumer Forum to dispose off the complaint case, without going into any other aspect of the matter, this writ application is being disposed off with a
Patna High Court CWJC No.17201 of 2018(2) dt.18-10-2019 3/3 direction to the learned District Consumer Forum, Darbhanga to look into the grievance of the petitioner and in case the Complaint Case No. 59/2010 is still pending, let it be disposed off within a period of three months from the date of receipt/production of a copy of this order.
