The petitioner seeks pre-arrest bail in connection with Ghosi P.S. Case No.341 of 2015 registered under Sections 409 and 420 of the Indian Penal Code.

Regard being had to the allegation that despite withdrawing Rs.18,23,609/- from the bank in the financial year 2011-12, the construction work of 6 ACR has not been completed and despite reminders being issued by the authorities, the petitioner has neither refunded the unused amount to the tune of Rs.5,00,000/- nor completed the assigned work, I am not inclined

Patna High Court Cr.Misc. No.2900 of 2016 (3) dt.21-04-2016 2/2 to grant pre-arrest bail. Accordingly, the application under Section 438 of the Code of Criminal Procedure is rejected. However, in case the petitioner surrenders and seeks bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
