2. The petitioner has prayed for bail in connection with Nautan P.S. Case No. 407 of 2025 registered for the offence punishable under Sections 137(2), 87, 3(5) of the B.N.S., 2023.
3. The case of the prosecution, in short, is that on 08.08.2025, the minor daughter of the informant went to the shop of tailor but did not return till late night. The informant started searching her and he came to know that Sandeep Ram was seen with the girl and was taking her away on his bike. It is also alleged that when the informant went to inquire at the
Patna High Court CR. MISC. No.13565 of 2026(2) dt.12-03-2026 2/3 house of Sandeep Kumar, the petitioner and other family members assured him that his daughter will return but on next day it is alleged that she was being assaulted and abused.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that from perusal of the FIR, it is clear that the main thrust of allegation is against Sandeep Ram. The petitioner is only father of the Sandeep Ram. He also submits that similarly situated other co-accused persons namely, Godaniya Devi and Ravinder Kumar have been granted anticipatory bail by the learned coordinate bench of this court vide Cr. Misc. No. 78168 of 2025. He further submits that the victim has been recovered and she has stated in her statement before the police that she has gone with Sandeep Ram on her own sweet will. Moreover, a statement has been made in para 3 of the petition that petitioner has no criminal antecedent and he is languishing in judicial custody since 26.11.2025.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is
Patna High Court CR. MISC. No.13565 of 2026(2) dt.12-03-2026 3/3 inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Bettiah, West Champaran in connection with Nautan P.S. Case No. 407 of 2025.
