The petitioner is in custody in connection with Puraini P.S. Case No.104 of 2014 for the offences punishable under sections 467, 468, 471, 420 and 409/34 of the Indian Penal Code.
The allegation against this petitioner along with others is of conspiring to defalcate the bank money by drawing loan under the Kisan Credit Card and General Credit Card schemes against the name of certain account-holders and the informant is one of them.
Perusal of the FIR manifests that when the informant was informed regarding loan outstanding against his account that the matter was enquired into and when it transpired that similar kind of loans have also been made under the Kisan
Patna High Court Cr.Misc. No.58069 of 2015 (2) dt.22-01-2016 Credit Card and General Credit Card schemes in respect of other account-holders who have denied taking any loan. It also transpired that the previous Branch Manager R.P. Bhagat in collusion with other accused including the petitioner has misappropriated money by showing to be loan against some of the account-holders, who are ignorant of any such loan. The photographs of the present petitioner are stated to have been pasted in place of loan of Lukhar Yadav.
Learned counsel for the petitioner has submitted that it is only on account of the photograph of the petitioner pasted on Loan Account of Lukhar Yadav that the petitioner has been roped in the present scam along with others, some of whom have been granted bail by this Court vide order passed in Cr. Misc. No.17262 of 2015, Cr. Misc. No.39533 of 2015, Cr. Misc. No.42474 of 2015 and Cr. Misc. No.46525 of 2015 placed at Annexures 2 to 5 respectively.
Having heard learned counsel for the parties and considering the circumstances existing, let the petitioner, namely, Ranjeet Ram be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pradeep Kumar Chaudhary, Judicial Magistrate 1st Class, Uda-Kishunganj,
Patna High Court Cr.Misc. No.58069 of 2015 (2) dt.22-01-2016 district-Madhepura and/or the court concerned in connection with Puraini P.S. Case No.104 of 2014 subject to the following conditions:
(a) One of the close relative of the petitioner would stand as a bailor and would file an affidavit as regarding his/her relationship with the petitioner as also an undertaking of informing the court below regarding change of address of the petitioner; (b) The petitioner would file an affidavit to accept the police papers and if he avoids to do so, the court below would be at liberty to cancel his bail bonds and to take him in custody; and (c) The petitioner shall ensure his representation before the court below on each and every date fixed in the case and his failure to do so on two consecutive dates fixed without reasonable explanation to the satisfaction of the court below, would entitle the court concerned to cancel his bail bonds and to take him into custody.
