The petitioner seeks regular bail in connection with Nawkothi PS case no. 98 of 2018 registered for the offence punishable under Sections 302/34 of Indian Penal Code and 27 of Arms Act.
The learned counsel for the petitioner submits that in the written report, there is specific allegation against co-accused persons namely Dhiraj Singh and Bittu Singh @ Baibhav Vardhan of causing firearm injuries to the brother of the informant on account of which he succumbed to the injuries in hospital. The petitioner is alleged to have taken the brother of the informant on a car along with other co-accused persons
Patna High Court Cr.Misc. No.9533 of 2019(2) dt.20-02-2019 2/2 namely Diwakar Singh, Navneet Kumar and Vikram Kumar. It is further submitted that the co-accused persons namely Vikram Kumar and Diwakar Singh @ Diwakar Kumar have already been granted regular bail by a co-ordinate Bench of this Court vide order dated 24.01.2019 passed in Cr.Misc. no. 2182 of 2019 and order dated 30.01.2019 passed in Cr. Misc. no. 3264 of 2019 respectively. Lastly, it is submitted that the petitioner is languishing in custody 16.11.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Begusarai in connection with Nawkothi PS case no. 98 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
