None ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-02-2019 Heard learned counsel for the petitioners. No one appears for the State to oppose this application. Petitioners are seeking anticipatory bail in connection with Rajepur P.S. Case No. 147 of 2017 registered for the offences punishable under Sections 341, 447, 323, 324, 325, 307, 379 and 504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that so far as allegation of assault on vital part of the body is concerned, it is alleged only against Ajay Prasad (petitioner no.2). So far as other petitioners are concerned, there are general and omnibus allegations against them.
A perusal of the impugned order shows that the
Patna High Court Cr.Misc. No.9722 of 2019(2) dt.19-02-2019 2/2 mother of the informant had sustained three injuries not only on the head, but also on the chest wall and over left hand. She had suffered grievous injury. The allegation is that all the petitioners had assaulted the mother of the informant.
In the nature of the injuries which have been noticed in the impugned order, even though the allegation of assault on the head is against Ajay Prasad (petitioner no.2), this Court is not inclined to grant anticipatory bail to these petitioners as there are more than one injuries and all of them have allegedly participated in the assault.
The application is dismissed.
