The petitioner apprehends his arrest in Mahua P.S. Case No. 736 of 2021, registered for the offence punishable under Sections 30(a), 32(ii), 34(ii), 38(ii) and 41(i) of the Bihar Prohibition and Excise Act.

3158.370 litres of foreign liquor has been recovered from two vehicles.

It is submitted that petitioner has falsely been implicated in this case. Nothing has been recovered from conscious possession of this petitioner. Petitioner is neither owner nor driver of vehicles in question.

Counsel for the State vehemently opposed the bail application and submitted that petitioner has got criminal

Considering the facts aforesaid and criminal antecedents of similar nature, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
