The petitioner is in custody in connection with Mahila (Supaul) P.S.Case No.85 of 2016 registered for an offence under Sections 323, 494, 498(A), 504 and 506/34 of the IPC and Sections 3/4 of the Dowry Prohibition Act.

The petitioner is the husband of the informant and allegation is that he immediately after marriage started torturing his wife in connection with demand of Rs.50,000/- for establishing a shop. She has alleged that she was ousted from the matrimonial house on 10.03.2016.

Learned counsel for the petitioner submits that there is delay of six months in lodging the case. Petitioner is ready to keep

Patna High Court Cr.Misc. No.5908 of 2017 (2) dt.15-02-2017 2/2 his wife with full dignity and honour and to this effect he has filed an undertaking before the court below. The petitioner is in custody since 23.10.2016.

However, learned APP opposed the prayer for bail. Considering the undertaking of the petitioner as well as his custody, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Sukul Ram, Judicial Magistrate, Supaul in connection with Mahila (Supaul) P.S.Case No.85 of 2016/G.R.No.1558 of 2016.
