JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 20-04-2016 Both the writ applications more or less demand a similar kind of relief and direction to grant them benefit of promotion of graduate trained scale as well as on the post of Headmaster against vacancies existing in the concerned district. So far as the first aspect is concerned i.e. grant of graduate trained scale, that aspect of the matter is no longer a matter of dispute. Now, the question of grant of promotion on the post of Headmaster is vexing the petitioners because, according to them, they are entitled to such benefit right from the year 2013. It is also known that vide order dated 12.8.2014 issued
8/8 by the General Administration Department, Government of Bihar, a blanket ban was put on grant of any kind of promotions due to a pending litigation. But that letter stands quashed now and the stand of the State in the counter affidavits filed in the two writ applications is that the Departmental Promotion Committee is now going to meet and take decisions with regard to such promotions. If that be so then the grievance of the petitioners has been accepted by the State. The Court expects that since there is already inordinate delay in consideration because of the ban, it will be in the interest of good administration as well that the matter is expedited and decision taken with regard to all the eligible candidates, who otherwise fulfill requirements for such grant of promotion. The Court fixes an outer limit of six months, if not earlier, for such exercise and deliberation.
Both the writs stand disposed of with the above direction.
