JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354(B), 506 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.

The prosecution case is that the informant along with her sister Hassina were returning home from a fair when the petitioner while going from Scorpio vehicle requested them to sit when other accused persons were also there and they misbehaved with the informant and her sister. It is submitted by learned counsel for the petitioner that due to the petty dispute the accusation has been levelled. Moreover, for the occurrence of 12.11.2015 the F.I.R was registered on 13.11.2015.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.3123 of 2016 (2) dt.25-01-2016 2/2 Considering the delayed lodging of the case and the nature of accusation, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Magadh University(Bodh-Gaya) P.S. Case No. 71 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate-IX, Gaya. With the observations above, the application stands disposed off.
