1. The State of Bihar .... Opposite Party ====================================================== Appearance :
For the Petitioner : Mr. Bimal Kumar, Adv. For the Opposite Party : Mr. Iftekhar Mahmood, APP 202 ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 18-04-2017 Heard the learned counsel for the petitioner and the State.
This is a petition for grant of regular bail for offences under Sections 30(a) and 37(c) of the Bihar Excise (Amendment) Act, 2016.
Allegation against the petitioner is that he was creating nuisance in the office after consuming wine. The impugned order reveals that the learned Sessions Judge has allowed liberty for renewal of prayer after completion of three months in custody or after framing of the charge, whichever is earlier.
I do not find any reason to interfere with the order of the learned Sessions Judge, Katihar. Hence, this application is dismissed with liberty to the petitioner to renew the prayer before the learned Sessions Judge, Katihar, in pursuance of the impugned order.
