The petitioner seeks bail in connection with Madhepura Excise Case No. 33/2021 lodged under Section 30 (a) of the Bihar Prohibition and Excise Act, 2018. As per allegation made in the FIR, total 940 bottles each containing 100 ml of illegal cough syrup were recovered from the house of the petitioner.
Learned counsel for the petitioner submits that charge sheet has already been submitted in this case and the petitioner is in custody since 09.12.2021 having no criminal antecedent. He further submits that alleged recovered material is not excise material rather is a medicine i.e. cough syrup.

In the facts and circumstances of the case that petitioner is in judicial custody since 09.12.2021 having clean antecedent, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-4th cum Special Judge Excise 2nd, Madhepura, in connection with Madhepura Excise Case No. 33/2021.
