The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341/323/379/307/504/506/34 of the Indian Penal Code. Prosecution case is that on protest being made for grazing the maize crops of the informant by the co-accused Birendra Yadav and the petitioners through cattle, Birendra Yadav assaulted on the head of the informant by pistol and further ordered to kill whereupon petitioner no.1 Ravindra Yadav and co-accused Manjeet Yadav assaulted the informant by iron rod and snatched his gold locket. It is further alleged that co-accused Santu Yadav, Rajesh Yadav and petitioner no.2

Patna High Court Cr.Misc. No.3044 of 2016 (2) dt.19-01-2016 2/2 Umesh Yadav assaulted the informant by 'lathi' and snatched Rs.4500/-.

It is submitted by learned counsel for the petitioners that the informant has received only three injuries apparently appear to be simple in nature. Though with regard to some of the injuries opinion has been kept reserved and in the background of land dispute the accusation has been levelled. The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Mansi P.S. Case No.152/2015, pending before the learned CJM, Khagaria. With the above observation, this application is, accordingly, disposed off.
