2. The petitioners apprehend their arrest in connection with Atri P.S. Case No. 138 of 2022, instituted under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504 & 506 of the Indian Penal Code.

3. As per the prosecution case, on 12.04.2022 at about 8 P.M. petitioners along with F.I.R. named accused persons armed with lathi-danda came and attacked the members of prosecution party causing injury. The occurrence took place due to flow of drainage water of the informant from the door of the accused persons.

4. Learned counsel for the petitioners submits that petitioners have not committed any offence. There is no direct allegation against them. They are neighbours. There is case and counter case between the parties for the same occurrence. Petitioners have no criminal antecedents. They undertake to cooperate in the investigation.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIII, Gaya/ concerned Court in connection with Atri P.S. Case No. 138 of 2022, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973.
