JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-04-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with Chhatauni P.S. Case No. 11 of 2017, registered under Sections 413 and 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is of recovery of six bottles, each containing 300 ml Nepali Soufi liquor, from the Bolero vehicle, in which, petitioners and three others were found sitting. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case mere on

Patna High Court Cr.Misc. No.17579 of 2017 (2) dt.27-04-2017 suspicion as they were standing near the Bolero vehicle. It is further submitted that petitioners are in custody since 14.01.2017. Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, in connection with Chhatauni P.S. Case No. 11 of 2017. Out of two sureties, one surety must be the close relative of the petitioners.
