====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 The petitioner seeks regular bail in connection with Deepnagar P.S. Case No. 430 of 2018, registered for offences punishable under Sections 409 and 420 of the Indian Penal Code.

As per FIR, Rs. 28,000/- was withdrawn by Upsarpanch, Binod Yadav that has not been paid to the Kchahari Secretary, Reshmi Kumari and it further appears that cheque was issued under the signature of the petitioner. Submission of learned counsel for the petitioner is that FIR itself shows that the amount has not been withdrawn by other co-accused and not by the petitioner and further the coaccused has already deposited the above amount and petitioner is in judicial custody since 20.12.2019.

Heard learned A.P.P. who has opposed the prayer for bail.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Deepnagar P.S. Case No. 430 of 2018.
