JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-06-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State as well as learned counsel for the Magadh University.

Grievance of the petitioner in the present writ application is non payment of leave encashment, revised salary and GIC.

Learned counsel for the petitioner submits that family pension of the petitioner has not been fixed and he has not been paid revised pension. He submits that similarly circumstanced have been paid all retiral dues but the petitioner was denied payment on the ground of paucity of fund. He further submits

Patna High Court CWJC No.4347 of 2020(2) dt.24-06-2020 2/2 that the benefit of the revised pay has not been paid to the petitioner.

Considering the aforesaid, the writ petition is disposed of with a direction to the respondents to consider the claim of the petitioner for payment of difference of revised salary and revised pension and all other retiral dues within a period of four months from the date of receipt/production of a copy of this order, failing which the petitioner shall be entitled to payment of interest @ 9 per cent from the date of filing of the writ petition till the date of actual payment.

If the petitioner has any other grievance, liberty shall be available to the petitioner to approach the respondent authority by way of filing representation alongwith this order and the respondent Vice-Chancellor shall appropriately decide the representation by reasoned order within a period of three months of filing representation.

With the aforesaid, the writ application stands disposed of.
