JUSTICE SATYAVRAT VERMA ORAL ORDER 11-03-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Sahebganj P. S. Case No.517 of 2021, instituted for the offences under Sections 272, 273/ 34 of the Indian Penal Code and Section 30(a) of the Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 20.11.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 25 litre of liquor from a gallon.

The learned counsel for the petitioner submits that petitioner was a passer-by and he came to be implicated when

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Court No. II, Muzaffarpur in connection with Sahebganj P. S. Case No.517 of 2021.

The application stands allowed.
