JUSTICE SHIVAJI PANDEY ORAL ORDER 13-10-2020 Heard learned counsel for the petitioner and learned counsel for the State through Virtual Court Proceeding. In this case, the petitioner is seeking regular bail in connection with Manjhagarh P.S. Case No. 140 of 2018 (G.R. No. 2196 of 2018), registered for the offence under Sections 394 of the Indian Penal Code.
Allegation has been made that six persons including this petitioner have committed robbery. Learned counsel for the petitioner submits that coaccused Aditya Tiwari has been granted bail by a coordinate Bench of this Court in Criminal Miscellaneous No.22559 of 2019 vide order dated 09.04.2019. He further submits that out of six accused persons, two accused persons have been put to trial
Patna High Court CR. MISC. No.8246 of 2020(5) dt.13-10-2020 2/2 and have been acquitted, inasmuch as, the petitioner is in jail since 01.08.2019.
Considering the aforesaid fact as well as the period of custody, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Gopalganj, in connection with Manjhagarh P.S. Case No. 140 of 2018 (G.R. No.2196 of 2018) subject to the condition that the petitioner would fully cooperate with the investigation / trial of the case, failing which, the Court below shall be at liberty to cancel the bail bond of the petitioner. This is also subject to the condition that the petitioner shall mark his presence before the nearest Police Station by 7th of every month for six months.
