JUSTICE SANJAY PRIYA ORAL ORDER 27-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sanjhauli P.S. Case No. 89 of 2016 instituted for the offence under Sections 365/34 of the Indian Penal Code.

As per allegation, the daughter of the informant who was student of Class IX went to her school and did not return. In the evening, the informant alleged that during search, she went to the house of the accused person and found school bag of her daughter in the house of the accused.

The statement of victim girl has been recorded under Section 164 Cr. P.C. wherein she has not whispered any allegation against the petitioner. She stated that she was taken to Sasaram Railway Station by one Sunil and then another boy took her in his room and committed illegal act with her, but she has

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bikramganj, Distt.
