JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Warisaliganj P.S. Case No.18/2015 registered under Section 392 of the Indian Penal Code.

The accusation is that the informant, being incharge of the Headmaster withdrew Rs. 3,63,000/- for the year 2014-2015 from Madhya Gramin Bank, Warisaliganj (Dariyapur) and the same were distributed among the children and the rest amount of Rs. 45,000/- was being carried by him and when he was going through Manjaur field, three unknown persons came on a motorcycle and snatched his bag containing Rs. 45,000/-, passbook of M.B.G.B along with signed two cheques, registers,

Patna High Court Cr.Misc. No.57646 of 2015 (3) dt.18-02-2016 seal and mobile showing revolver and fled away. Learned counsel for the petitioner submits that the petitioner is not named in F.I.R. In course of investigation, the name of the petitioner and others came in the confessional statement of co-accused namely Amrit Raj showing his involvement in the present case. The further submission is that except confessional statement of co-accused, there is no material against the petitioner in the present case.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Nawada in connection with Warisaliganj P.S. Case No. 18/2015. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J.) Amit/- U T
