2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Majorganj P.S. Case No. 362/2023 registered for the offence punishable under Sections 21(c)22/(c)/23(c) of the NDPS Act.
3. Earlier the bail application of the petitioner has been rejected vide order dated 18.04.2024 passed in Cr. Misc. No. 11166 of 2024.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is in jail since 20.12.2023 and claims clean antecedent.
5. Considering the period of custody, this application
Patna High Court CR. MISC. No.11856 of 2025(2) dt.11-04-2025 2/2 is allowed.
6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Sitamarhi/concerned Court in connection with Majorganj P.S. Case No. 362 of 2023.
7. At the time of accepting bail bonds of the petitioner, the Court below will verify the criminal antecedent of the petitioner. If it is found that the petitioner has criminal antecedent, the Court below shall not accept the bail bonds of the petitioner and if it is found that the petitioner has clean antecedent, his bail bonds shall be accepted by the Court below.
