JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.
The petitioner wants to renew the prayer of bail, which was earlier rejected by order dated 07.04.2016 passed in Criminal Miscellaneous No. 5369 of 2016, on the ground that the petitioner is suffering in custody since 10.10.2015, during investigation contradictory statements have come and, as such, the petitioner deserves sympathetic consideration. There was case and counter case.
The learned A.P.P. duly assisted by learned Senior Counsel for the informant opposes the prayer of bail by submitting that the petitioner is the assailant.
In the facts and circumstances as stated above,
Patna High Court Cr.Misc. No.9025 of 2017 (3) dt.29-03-2017 2/2 finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected. However, considering the detention of the petitioner, learned Magistrate is directed to commit the case at once so that the trial be concluded as early as possible preferably within nine months after commitment.
