JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-01-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The accusation against the petitioners is that they stopped the informant, snatched his belongings and petitioner no. 1 opened fire causing firearm injury to the informant. Submission on behalf of the petitioners is that the petitioners are resident of neighbouring village of informant and as a matter of fact, the informant in collusion with police planted this false case against the petitioners and that is the reason, the so called looted amount of Rs. 28,000/- has not been recovered from conscious possession of the petitioners and so far as recovery of identity card of the informant is concerned, it is unbelievable that
Patna High Court Cr.Misc. No.1584 of 2016 (2) dt.15-01-2016 2/2 petitioners will snatch the identity card and keep the same with them.
Taking note of the submission as well as this aspect of the matter that petitioners do not have any criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st class, Banka in connection with Katoria ( Jaipur) P.S.Case No. 242 of 2015.
