JUSTICE SHIVAJI PANDEY ORAL ORDER 03-06-2020 Heard Mr. Nafisuzzoha, learned counsel for the petitioner and Mr. Ram Sevak Choudhary, learned counsel for the State through video conferencing In this case, the petitioner is seeking regular bail in connection with Raghopur P.S. Case No.230 of 2019 registered for offence punishable under sections 302, 120(B)/34 of the Indian Penal Code.

An FIR has been lodged making allegation that 10-12 days earlier, there was a dispute between Murtuza @ Laddu and Puppu Kamat in which he had given threatening. On 27.10.2019, Md. Jakir Hussain, Md. Matloom and Md. Sah Alam along with other co-accused came to the house of the informant and talked to his brother and threatened that he will be finished and on 28.10.2019 the informant heard information

Patna High Court CR. MISC. No.8259 of 2020(3) dt.03-06-2020 2/2 that his brother has been killed near to vegetable market of Kailesh Prasad. The name of the petitioner has come during investigation.

Learned counsel for the petitioner submits that there is nothing against the petitioner.

I have perused the case diary and learned counsel for the State has shown his inability to make statement with regard to the paragraph of the case diary, on account of the virtual court proceeding.

Looking to the facts and circumstance of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Biraul at Supaul in connection with Raghopur P.S. Case No.230 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. (Shivaji Pandey, J) Mahesh/- U T
