2. The petitioner is in custody in connection with Paroo P.S Case No. 43 of 2023 registered for the offences punishable under Sections 302/34 of the I.P.C.
3. As per prosecution case, as alleged Om Prakash Singh, who has alleged that in the early morning of 28.01.2023, his neighbours Udai Raj Kumar and Randhir Raj Kumar @ Jhunjhun Singh and some unknown took his brother Jai Prakash Singh from house at a distance of 50 ft and started assaulting him. It is further alleged that Udai Raj Kumar asked his brother to
Patna High Court CR. MISC. No.12704 of 2024(3) dt.16-04-2024 2/3 kill Jai Prakash Singh and thereafter, Randhir Raj Kumar @ Jhunjhun Singh sat on his chest and Udai Raj Kumar killed him by twisting his neck.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that It is also submitted that petitioner is in judicial custody since 25.10.2023.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR, case diary and impugned order dated 09.01.2024 it appears that, as per postmortem report it reveals that cause of death has been kept reserved till the report of chemical analysis and injury nos. 1 and 2 are caused by hard and blunt object as injury no. 1 abrasion 1"*1/2" on upper part of the neck and injury no. 2 is abrasion 1/4"*1/4" over right lower abdomen. As per para 4 of the case diary the doctor has opined that there is no unnatural cause of death was found and cause of death of the deceased might be natural and also considering the aforesaid facts
Patna High Court CR. MISC. No.12704 of 2024(3) dt.16-04-2024 3/3 and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M-1st Class Muzaffarpur (West) in connection with Paroo P.S Case No. 43 of 2023.
