The petitioner claims to be the wife of late Satya Narayan Kamat The submission is that her husband, namely, Satya Narayan Kamat, died on 04.09.2005.

The grievance of the petitioner is that in spite of several representations, the death-cum-retiral benefits have not been paid. A counter affidavit has been filed on behalf of

Patna High Court CWJC No.4521 of 2014 dt.17-05-2016 2/2 respondent nos. 2 and 6.

In view of averments made in paragraph 8 and 15 of the counter affidavit, learned counsel for the petitioner seeks permission to withdraw this application to move appropriate forum for issuance of Succession Certificate.

It goes without saying that while filing the Succession case, the petitioner would make the other woman, who is claiming to be the wife of late Satya Narayan Kamat, as party respondent. The Succession certificate would bind the parties. The writ application stands withdrawn in the aforesaid terms.
