The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 325, 307, 302, 379, 504 of the Indian Penal Code.

Allegation is that co-accused Dillu Paswan assaulted on the head of the father-in-law of the informant, namely, Ramashish Paswan by means of khanti, due to which he sustained grievous head injury resulting his death. When Anup Paswan and Ravindra Paswan tried to rescue him, then the accused persons assaulted them.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.11.2019 and has got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.9128 of 2020(2) dt.05-03-2020 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is alleged to have assaulted upon one Anup Paswan. There is no allegation of assault alleged against the petitioner upon the deceased. No injury has been caused by the petitioner upon the deceased. The main allegation is against the co-accused, namely, Dillu Paswan, who is alleged to have assaulted the deceased which led to his death. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Barh, Patna in connection with Belchhi P.S. case No.65 of 2019.
