The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 406, 419, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code.

As per prosecution story, the informant got secret information that some miscreants are indulged in Cyber crime on the name of providing loan from Bajaj Finance, he along with police officials reached there and arrested accused persons and recovered mobiles phones

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not involved in any act as alleged in FIR rather he has falsely been made accused in the present case. Petitioner was not apprehended on the spot and his name sprang up on the basis of confessional statement of co-accused persons. Petitioner has no concern with the alleged recovery as well as co-accused persons. It is further submitted that the petitioner is languishing in judicial custody since 29.09.2022. Similarly situated Co-accused person, namely, Babulal @ Babulal Rana @ Babulal Kumar has been granted bail vide order dated 23.02.2023, passed in Cr. Misc. No. 19512 of 2023 by this Court.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case,

The above named petitioner is directed to be released on bail in connection with Shekhopur Sarai P.S. Case No. 158 of 2022 on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura.
