====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-03-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 420, 467, 468, 471, 386, 120B/504 of the Indian Penal Code.

3. As per the prosecution case, all the FIR named accused persons including these petitioners got executed sale deed with respect to 17.37 acres land of the informant in their name by way of executing forged sale deed.

4. It is submitted on behalf of the petitioners that petitioners have falsely been implicated in this case merely on suspicion. From bare perusal of the FIR, it appears that some

No.10583 of 2025(2) dt.07-03-2025 2/3 area of the land in question of Khata No. 1690, Khesra No. 1861-1862 was executed on dated 17.05.1941 by one Maksudan Singh, grand father of the informant in favor of one Tej Narayan Singh and Tirpit Narayan Singh. Thereafter, Maksudan Singh executed other area of 2 acre 47 decimal and 7 acre and 5 decimal on dated 06.10.1983 in favor of Ram Vilash Singh vide Kewala No. 11111, Sl. No. 11012. It is further submitted that from bare perusal of the another F.I.R. vide Rangra P.S. Case No. 15 of 2024 dated 16.04.2024 it appears that one Birendra Singh has lodged the case u/s- 147,149,341,323,379,504,506 of the IPC. against the petitioners and others for the same land in question in Khesra No-1861-1862. Moreover, dispute is of civil nature and no criminal case is made out against the petitioners.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Naugachhia Bhagalpur in Gopalpur Rangra Police
