The petitioner has preferred this application for grant of regular bail in a case registered under sections 307 and 34 of the Indian Penal Code and sections 25(1-B)(a), 26, 27 and 35 of the Arms Act.

As per the prosecution case, a team was constituted and they proceeded with the intention to nab the kidnappers who were in touch with informant Chhotu Kumar for the ransom amount. It is stated that one of the accused fired. The petitioner was amongst the two accused who was arrested. It is submitted by learned counsel for the petitioner that so far as the kidnapping is concerned, a separate FIR being Mufassil P.S. Case no. 310 of 2020 was registered. The

Patna High Court CR. MISC. No. 20486 of 2021(2) dt.21-09-2021 2/2 allegation against the petitioner here is of recovery of two live cartridges for which he has remained in custody since 16.9.2020 and charge sheet has been submitted in the case. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Mufassil P.S. Case no. 311 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XIII, Gaya.
