Sasaram P.S. Case No. 05 of 2019, registered for the offence punishable under Section 3 of the Railway Properties (Unlawful Protection) Act.

Allegation is of recovery of 18 Kg. of coper wire which was taken from the place where railway electrification work was done.

Submission of learned counsel for the petitioner is that he has falsely been implicated and moreover he is in custody for almost one year.

Heard learned APP also.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of

Patna High Court CR. MISC. No.8229 of 2020(2) dt.25-02-2020 2/2 the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway, Gaya, in connection with R.P.F. Sasaram P.S. Case No. 05 of 2019 on the condition that petitioner has to appear before R.P.F., Sasaram for a period of nine months or till conclusion of trial, whichever is earlier, so that the R.P.F. personnel may watch his activities and if involvement of the petitioner in such type of cases is found in future, prosecution is at liberty to move for cancellation of his bail bonds Let a copy of this order be communicated to the SHO, R.P.F., Sasaram for needful.
