ANJANA MISHRA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code and Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Learned counsel for the petitioners submits that admittedly the deceased was done to death by a mob on the allegation that he had been instrumental in carrying and sale of animals which was resisted by the members of the public. It is further submitted that the names of these petitioners appear in the First Information Report only on hear-say of co-villagers and the informant is not

Considering the nature of allegation made against these petitioners and there being no specific role assigned to them, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Saran, at Chapra in connection with Bhagwan Bazar P.S. Case No. 274/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
