The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial no. 1076 of 2022 (arising out of Rajepur P.S. Case no. 127 of 2022) registered under sections 399, 402 and 414 of the Indian Penal Code and sections 25(1-b)(a) and 35 of the Arms Act. As per the prosecution case, on receiving information about accused persons having gathered, it is stated that a raid was conducted and on search two country made pistol and a live cartridge was recovered from the petitioner's possession. Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner's possession who has been falsely implicated in the case. He is in

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioner having remained in custody for more than a year since 6.2.2022 and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no. 1076 of 2022 (arising out of Rajepur P.S. Case no. 127 of 2022) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XX, East Champaran at Motihari.
