This is a petition for grant of regular bail in a case registered for offences punishable under Sections 420, 120 (B) and 379 of the Indian Penal Code.
It has been submitted by the learned counsel for the petitioners that the petitioners, who are Driver and owner of the tempo, are innocent and have falsely been implicated in the present case merely on basis of suspicion, because there is possibility that bag of the informant might have been taken by some other passengers of the tempo. The allegations levelled against the petitioners are concocted, wrong, false and baseless
Patna High Court Cr.Misc. No.4968 of 2017 (2) dt.09-03-2017 2/2 and are in custody since 01.11.2016.
Considering the facts and circumstances, let the above named petitioners, namely, Mohar Baitha and Satendra Singh are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra (Town) P.S.Case No. 496 of 2016.
