The petitioner, namely, Arvind Kumar Singh is in custody in Majorganj P.S. Case No.320 of 2014 under Sections 341, 323, 307, 504, 34 of the Indian Penal Code and 27 of the Arms Act.

The learned counsel for the petitioner submitted that the F.I.R. is against unknown. Nothing has been recovered from the petitioner and in similarly situated case, the other co-accused Pintu Singh and Chetan @ Chetan Kumar @ Prince Kumar @ Prince Singh have already been granted bail by this Court in Cr. Misc. No.43043 of 2015 and 47025 of 2015 and the case of the petitioner is on same footing.

Patna High Court Cr.Misc. No.55656 of 2015 (2) dt.15-12-2015 Perused the F.I.R. and the order passed by this Court in aforesaid criminal miscellaneous application. Admittedly, the petitioner is not named and the co-accused persons, who have named by the co-accused in his confession, have already been granted bail by this Court.

Considering the above facts, I direct the petitioner named above to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Majorganj P.S.
