JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under various sections of the Arms Act. Earlier the prayer for bail of the petitioner was rejected by this court but bail of the petitioner is sought on the grounds that he is languishing in jail custody since 06.12.2015 whereas having more or less similar allegation, one co-accused, Pintu Kumar has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 11.01.2017 passed in Cr. Misc. No. 54338 of 2016.

Taking note of the aforesaid submissions as well as period of detention of the petitioner in jail custody, let the

Patna High Court Cr.Misc. No.4564 of 2017 (2) dt.01-03-2017 2/2 petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Danapur, Patna in connection with Dulhin Bazar P.S. Case No. 194 of 2015.
