31-08-2021 Heard learned counsel for the parties through video conferencing.

Earlier, the bail petition of petitioner was rejected, vide order dated 03.07.2019 passed in Cr.Misc. No. 40009 of 2019 with following observation:

"Since trial is going on, there is no reason to entertain the prayer for bail. The petition stands dismissed."

On last occasion, vide order dated 13.07.2021, a report with regard to present stage of the trial was called for, which has been received and from perusal whereof, it reveals that out of ten chargesheeted prosecution witnesses, eight witnesses have already been examined and rest two witnesses, including the victim and the I.O. are yet to be examined. Patna High Court CR. MISC. No.20280 of 2021(3) dt.31-08-2021 2/2 progress of the trial, the bail petition of petitioner is rejected. However, since the petitioner is in custody since 21.03.2018, the learned trial court is directed to conclude the trial as early as possible.
