The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363, 366(A), 379, 506/34 of the Indian Penal Code and section 3/4 of the POCSO Act.

As per the prosecution case, petitioner with the help of co-accused persons abducted the daughter of informant. Informant found that ornaments and cash of Rs. 45,000/- were also missing from the house.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. The victim girl in her statement under Section 164 Cr.P.C has categorically stated that she made telephonic call to the petitioner, thereafter

No.10807 of 2023(2) dt.15-05-2023 2/2 petitioner came to the Motihari Railway station from Mumbai and thereafter, the victim and the petitioner went to Delhi on 16.05.2022 and executed a marriage deed. The age of victim girl has been assessed as 18 years. Petitioner claims clean antecedent In view of the statement of victim girl under Section 164 Cr.P.C, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge, POCSO Act, East Champaran at Motihari in connection with Piprakothi P.S.
