JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2019 This is an application for grant of anticipatory bail in connection with Rahui P.S. Case No. 389 of 2018, disclosing offences under Sections 341, 323, 504, 506, 354, 307, 34 of the Indian Penal Code.
Allegation against the petitioner no.1 is of assault by butt portion of the pistol on the forehead of the informant and petitioner no.2 is also named in the F.I.R.
Submission of learned counsel for the petitioners is that no case is made out under Sections 307 and 354 of the Indian Penal Code, as the allegation of assault by butt portion of the pistol. Further, they have no criminal antecedents. Heard learned A.P.P. also.
Having heard both sides, considering the above
Patna High Court Cr.Misc. No.10937 of 2019(2) dt.22-02-2019 2/2 submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif, in connection with Rahui P.S.
