The petitioners seek anticipatory bail in a case instituted for the offence under Section 379 of the Indian Penal Code and Sections 33, 41, 42 of the Forest Act, Sections 4(1-a), 21(1)D.E. Act and Section 40(1) of B.M. Act.

It has been submitted that name of the petitioners have been disclosed by local person as mentioned in the written report. They were not found on the spot.

As per the written report, the police raided several places where crusher machines were running for the purpose of preparing stone chips after illegal mining. It has been submitted

No.6020 of 2017 (2) dt.16-02-2017 2/2 that other co-accused have been granted anticipatory bail by coordinate Benches of this Court vide orders dated 29.6.2016, 19.1.2017 and 20.10.2016 passed in Cr. Misc. Nos. 17513 of 2016, 1692 of 2017 and 43849 of 2016. It is mentioned in paragraph-3 of the bail petition that the petitioners have clean antecedent.

Considering the facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Dihri (T) P.S. Case No. 77 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Dihri, Rohtas, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
