The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 341, 323, 307, 447, 504 & 506/34 of the Indian Penal Code. The allegation against the petitioner is that she assaulted the informant by means of iron rod sustaining injury on his head.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. She has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. It is further submitted that petitioner is a Parda Naseen lady and she has been implicated in the present
Patna High Court CR. MISC. No.10590 of 2023(2) dt.24-04-2023 2/2 case to save their skins from the rigors of the two cases lodged from the petitioner's side. Similarly situated co-accused, namely, Priya Ranjan Kumar @ Priya Ranjan Singh and another have been enlarged on bail by a co-ordinate bench of this court vide order dated 06.01.2022 passed in Cr. Misc. No. 15382 of 2021. Petitioner has no criminal antecedent as mentioned in para-3 of this application.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Mashrakh P.S. Case No. 477 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) Trivedi/- U T
