JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 28-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioner seeks bail in connection with Parihar P.S. Case No.32 of 2016 registered under Sections 498(A), 494 and 504/34 of the Indian Penal Code besides Sections 3/4 of the Dowry Prohibition Act.

The accusation is of torturing the informant Kabita Devi by her husband (petitioner) and other in-laws due to non fulfillment of the dowry demand and ousting her from her matrimonial house alongwith her children after snatching her personal belongings.

Patna High Court Cr.Misc. No.6810 of 2017 (5) dt.28-04-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that the informant Kabita Devi, who is the wife of the petitioner, has lodged this case due to misunderstanding and now, the misunderstanding has been removed and the informant alongwith her children is residing with the petitioner at her matrimonial house. The petitioner is in custody since 19.11.2016. Learned counsel appearing on behalf of the informant also fairly submitted that at present, the informant alongwith her children is residing with the petitioner at her matrimonial house. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Sitamarhi, in connection with Parihar P.S. Case No.32 of 2016.
