The petitioner has preferred this application for grant of regular bail in a case registered under section 366A of the Indian Penal Code.

As per the prosecution case, the petitioner is alleged to have kidnapped the 17 year old daughter of the informant and inspite of search she was not to be found. It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and incorrect. The daughter of the informant returned and her statement was recorded under section 164 Cr.P.C. which has been brought on record as Annexure-3 to the supplementary affidavit. In her said statement, the daughter of the informant has categorically stated that she is in love with the petitioner, went with him out of her

Patna High Court CR. MISC. No.20611 of 2021(3) dt.30-09-2021 2/2 own volition and has married him. The petitioner is in custody since 13.8.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the contents of the statement of the daughter of the informant under section 164 Cr.P.C. together with the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with Akbarpur P.S. Case no. 345 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada.
