JUSTICE SANJAY PRIYA ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bathnaha P.S. Case No. 89 of 2013 (Sessions Trial No. 529 of 2014) instituted for the offence under Section 394 of the Indian Penal Code. It has been submitted that name of this petitioner has come in paragraph-22 of the case diary in the confessional statement of co-accused Vikash Das. From the written report it appears that the petitioner is not named.
It is mentioned in the impugned order that the name of petitioner has transpired in paragraph-22 of the case diary in confessional statement of Vikash Das who has been granted bail by a coordinate Bench of this Court vide order dated 17.12.2013 passed in Cr. Misc. 49772 of 2013.
Patna High Court Cr.Misc. No.6165 of 2017 (4) dt.19-04-2017 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Sitamarhi, in connection with Bathnaha P.S.
