The petitioner is in custody in connection with Sonepur Rail P.S. Case No. 56 of 2015 for offence punishable under Sections 399, 402 and 414 of the Indian Penal Code. The petitioner along with some others were charged with attempting train dacoity as well as recovery of incriminating articles supporting such complaint.

Learned counsel for the petitioner with reference to the FIR has submitted that except for a knife and two mobiles nothing else was recovered from the petitioner and that the petitioner has a clean antecedent not having been involved in any other criminal case.

Having heard learned counsel for the parties and

Patna High Court Cr.Misc. No.58162 of 2015 (2) dt.25-01-2016 considering the nature of allegations made, let the petitioner Nagendra Bhagat be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Sonepur in connection with Sonepur Rail P.S. Case No. 56 of 2015.
