The petitioner seeks bail in Andharatharhi P.S. Case No. 41/2018, instituted for offences under Section(s) 457 and 380 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. His name has come during investigation in the confessional statement of co-accused Amrendra Paswan. There is no recovery of any incriminating article from possession of this petitioner. No T.I.P. has been held in this case.

Learned counsel for the petitioner has submitted that petitioner has been remanded in this case while he was in custody with regard to Rudrapur P.S. Case No. 18/2018.

Patna High Court Cr.Misc. No.11077 of 2019(2) dt.25-02-2019 2/2 Learned Addl. P.P. has submitted that nine more cases are pending against this petitioner.

Petitioner is in custody since 26.06.2018.

Keeping in view the period of custody of the petitioner and nothing has been recovered from possession of petitioner, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IIIrd, Jhanjharpur, Madhubani in connection with Andharatharhi P.S. Case No. 41/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
